1. Introduction

Welcome to Juneplum ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Juneplum platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

2. Account Registration

  • You must be at least 18 years old to use our Services
  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access to your account

3. Subscription and Billing

3.1 Free Trial

We offer a free trial period for new users. During the trial period, you have full access to the Services. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

3.2 Subscription Fees

Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method for the applicable subscription fees.

  • Fees are non-refundable except as required by law or as explicitly stated in these Terms
  • We reserve the right to change our subscription fees with 30 days' notice
  • Price changes will not affect your current billing cycle

3.3 Payment Processing

All subscription payments are processed through third-party payment processors (PayPal and Inkress). By providing payment information, you represent that you are authorized to use the payment method provided.

4. Cancellations and Refunds

4.1 Subscription Cancellation

  • You may cancel your subscription at any time from your account settings
  • Cancellations take effect at the end of your current billing period
  • You will retain access to the Services until the end of your paid period
  • No partial refunds are provided for unused time in a billing period

4.2 Refund Policy

Subscription Fees: Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion in the following circumstances:

  • Technical issues that prevent you from using the Services for an extended period
  • Billing errors or duplicate charges
  • Service disruptions caused by us that significantly impact your ability to use the platform

Booking Transaction Fees: Transaction fees charged on customer bookings are non-refundable as they are paid to third-party payment processors (PayPal: 4.4% + $0.30, Inkress: 3.5%).

To request a refund, contact us at support@juneplum.app within 14 days of the charge. Refund requests will be reviewed on a case-by-case basis.

4.3 Booking Cancellations

As a business owner using Juneplum, you are responsible for setting your own cancellation and refund policies for customer bookings. We are not responsible for disputes between you and your customers regarding booking cancellations or refunds.

4.4 Deposit Payments

Business owners may configure services to require a deposit payment (a percentage of the total service price) at the time of booking. By enabling deposit payments, you acknowledge and agree to the following:

  • Balance Collection: You are solely responsible for collecting the remaining balance from your customer at the time of the appointment. Juneplum does not facilitate or process the remaining balance payment.
  • Deposit Refunds: You are responsible for handling all deposit refund requests from your customers. Customers should contact you directly for deposit refunds, not Juneplum.
  • Refund Processing: If you agree to refund a deposit, you must process the refund directly through your payment processor (PayPal or Inkress). Juneplum cannot process refunds on your behalf.
  • Disputes: Any disputes regarding deposits are between you and your customer. Juneplum is not liable for deposit-related disputes, chargebacks, or claims.

By using the deposit feature, you understand that Juneplum acts only as a technology platform to facilitate the booking and initial deposit payment. You remain fully responsible for delivering the service and managing all financial arrangements with your customers.

5. Payment Processing and Payouts

5.1 Third-Party Payment Processors

All customer payments and business payouts are processed through third-party payment processors (PayPal and Inkress). Juneplum acts solely as a technology platform to facilitate these transactions and does NOT process, hold, or control any funds.

IMPORTANT DISCLAIMER: Juneplum is not a payment processor, financial institution, or money services business. We are not responsible for:

  • Delays, holds, or freezes on your account by PayPal, Inkress, or any other payment processor
  • Withheld funds, chargebacks, or payment disputes handled by the payment processors
  • Payment processor fees, policies, or terms of service
  • Account suspensions or terminations by the payment processors
  • Any losses resulting from payment processor actions or inactions
  • Currency conversion rates or exchange rate fluctuations
  • Tax obligations related to payments received through the platform

By using our Services, you acknowledge that your relationship with the payment processors is separate from your relationship with Juneplum, and you agree to be bound by their respective terms of service and privacy policies.

5.2 Payout Timing and Processing

Payment timing, payout schedules, and fund availability are determined solely by the payment processors (PayPal and Inkress). Juneplum has no control over:

  • When funds are released to your account
  • Payment verification or review processes
  • Holds placed on your account for risk management
  • Reserve requirements or security deposits

5.3 Fraudulent Activity and Chargebacks

You are solely responsible for the legitimacy of all transactions processed through your account. This includes:

  • Fraud Prevention: Implementing measures to prevent fraudulent bookings and payments
  • Chargebacks: Handling customer disputes and chargebacks directly with your payment processor
  • Identity Verification: Verifying the identity of your customers when necessary
  • Legitimate Services: Ensuring all services offered are legal and legitimate

Warning: If your account experiences excessive chargebacks, fraud complaints, or suspicious activity, payment processors may suspend or terminate your account. Juneplum is not responsible for any resulting losses or account closures.

You agree to indemnify and hold harmless Juneplum from any claims, losses, or damages arising from fraudulent activity, chargebacks, or payment disputes related to your use of the Services.

5.4 Prohibited Businesses and Transactions

You may not use Juneplum for any illegal, fraudulent, or high-risk activities, including but not limited to:

  • Money laundering or terrorist financing
  • Sale of illegal goods or services
  • Fraudulent or deceptive business practices
  • Pyramid schemes or multi-level marketing scams
  • Any activity that violates local, national, or international laws
  • Services that violate the payment processors' acceptable use policies

We reserve the right to immediately terminate any account suspected of engaging in prohibited activities without prior notice and without refund.

6. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Use the Services for fraudulent or illegal activities
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Use automated systems to access the Services without permission
  • Impersonate another person or entity

7. Intellectual Property

The Services and all content, features, and functionality are owned by Juneplum and are protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the content you upload to the Services (business information, service descriptions, images, etc.). By uploading content, you grant us a limited license to use, store, and display your content as necessary to provide the Services.

8. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, immediately and without prior notice, for conduct that we believe:

  • Violates these Terms or our policies
  • Is harmful to other users, third parties, or our business
  • Exposes us to liability or legal risk
  • Involves fraudulent, deceptive, or illegal activities
  • Violates any applicable laws or regulations
  • Involves money laundering, terrorist financing, or other financial crimes
  • Results in excessive chargebacks or payment disputes
  • Violates payment processor terms of service
  • Damages our reputation or business relationships

Immediate Termination for Illegal Activity

We have a ZERO TOLERANCE policy for illegal activity. If we suspect or become aware that your account is being used for any illegal purpose, fraudulent activity, or to facilitate crimes, we will:

  • Immediately suspend or terminate your account without warning
  • Retain all account data and transaction records for law enforcement
  • Report suspicious activity to relevant authorities as required by law
  • Cooperate fully with law enforcement investigations
  • Withhold any refunds or credits
  • Ban you permanently from using our Services

8.1 Effect of Termination

Upon termination of your account, you will immediately lose access to all Services, booking data, customer information, and account features. We are not obligated to provide refunds for any unused subscription time if your account is terminated for violating these Terms.

8.2 Data Retention After Termination

We may retain your data after account termination for legal, regulatory, or business purposes, including tax compliance, fraud prevention, dispute resolution, and law enforcement cooperation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUNEPLUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Juneplum and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Services. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
